Can I fight a citation for "running" a red light that would not change to green?
There is a stoplight near my home that is usually sensitive to vehicles approaching. On a few occasions (maybe 4 times in the 3 years I have lived here) the light has not responded to an approaching vehicle and has remained red for a long period of time (over 7 minutes with no traffic approaching the intersection). I work at a hospital and I come it at 5am so it is still dark outside and there is virtually no traffic out at that time of morning ( i.e. one moter scooter and one car drove by during this time). I waited over 5 minutes and the light wasn't responding to my car being there so I turned left and was pulled over by a police officer. The only other option I had was to sit there (or go home). I tried to explain to him about the light and its malfunction but he wrote me a citation anyway. What options do I have in this situation?
U.S. Govt. C. §830(a), says that a condition of property is dangerous only if it creates a substantial risk of injury when such property or adjacent property is used with due care “in a manner in which it is reasonably foreseeable that it will be used.” In other words, you would not be expected to sit and wait all night for a red light to change. If you proceeded carefully after opposing traffic was out of the intersection, that would be seen as using it with due care in spite of the malfunction.
Public entities are liable “for maintaining property in a condition that creates a hazard to foreseeable users even if those persons use the property for a purpose for which it is not designed to be used or for a purpose that is illegal.” Law Revision Comment of Govt. C. §830; Davis v. Cordova Recreation & Park Dist. (1972) 24 Cal.App.3d 789. In other words, even though you violated the red light law, you did so because the stuck signal created a hazard.
An example of supporting state case law:
Malfunctioning traffic signal at intersection, with lights stuck on red and green, held dangerous to motorists foreseeably passing through the intersection. Matthews v. State ex rel Dep’t of Transp. (1978) 82 Cal.App.3d 116.
That case law may or may not impress the traffic court judge.
Whether or not you are still found guilty, you can sue the city or county that is supposed to maintain those signals for damages, especially since this has happened in the past; with the possibility of recovering far more than the cost of your ticket.
