How can I sue for medical malpractice, and would it be sensible in my case?
I am a 17 year old male from CT. Recently I broke my wrist in a scooter accident. I broke my wrist in three places, most severely in the radius bone. After going to an orthopedic surgeon, I was told that due to my age, inserting pins into my wrist would be sufficient to heal the wrist. I had the surgery, and the cast for four weeks, and then the cast was removed and therapy had begun. However, now the doctor is telling me another surgery is required because the ulna has shifted after the pins were removed. He says that a second surgery is required in which a metal plate and screws will be inserted into my wrist. I wonder whether or not I can sue for malpractice seeing as if the doctor had put in a plate and screws in my hand the first time around, everything would have been fine. Please help me. I would prefer someone who is legally and/or medically competent.
As a citizen of the US, you are free to consult with an attorney in an effort to bring suit against anyone at any time. As far as doing so against a doctor, the burden of proof rests upon you to demonstrate that the doctor failed to provide the standard of care in your case. You will be surprised to learn how low that standard is.
Anyway, a few hundred bucks for fees and a chart review will determine whether or not you have a case to pursue. However, be prepared to find another doctor as he may choose to not treat you after this.
