i was hit by a car on my scooter?
a man in the on coming lane didn't see me and turned in front of me and i thought my life was over. It collapsed my lung and screwed up my knees/back really bad- that being said I'm glad I'm alive but my freaking medical bills are probably 15k or more now and I'm not done with psychical therapy. I receive unemployment benefits but cant go back and do the same work i was doing. i have a lawyer and he says everything is going to be fine- my question is how much longer is it going to take to settle? and how much will i get ? I'm worried my medical bills and lawyer fees will outweigh my settlement but lawyer says he has more than the state required minimum.im also worried that my unemployment benefits will effect my case. I had to drop school that semester bc i got hit on the way to school- I'm a basket case ill never ride a scooter again.
hang in there bo this was a serious life changing event, give yourself the gift of time to heal, ok? here is a rough guess of how things are going, generally until you reach a point where your physical injuries have stabilized, and your condition is to the point you no longer need the physical therapy. When you get to the point you are more or less permanent and stationary with your physical injuries, then the insurance company and your attorney will discuss a settlement offer. the medical bills will be paid, the offer for pain and suffering (they have a fancy name for it, im sorry off hand it escapes my brain for the moment) you will end up with a substantial chunk of change. It sounds like the guy had insurance above the state minimum, which is good for you, until you are out of physical therapy, and the medical bills are figured out in total, there is no way to give you a time frame, as the higher the medical goes, the more money you will get, after it is all said and done, the attorney gets approximately one third of the settlement, including the medical bills.
So it will take some time, do not shortchange yourself on any medical injuries, if you are unable to return to the job you were able to do before, this is worth money. so if you have ongoing pain, or physical problems, it is best to make sure your doctor is aware of this. You did not mention a date of the accident, but with extensive injuries, like yours, it takes a while for things to get worked out. your unenjoyment will not affect the settlement, do not volunteer any information about the accident to any government agency, with out first discussing it with the attorney, if you are still in physical therapy, then tighten up the belt a little you are still many months from a settlement, there will be a decent chunk of change, so hang in there, the body has an amazing ability to heal itself, I have been in more than one major accident, and have taken as long as two years to get back into physically better shape, be patient, follow the doctors orders, and heal your body.
when times get tough, the tough get going, so do what you have to do, to take care of you. as for being a basket case because you were on the scooter, I have been slammed in rush hour traffic by an illegal alien with no insurance, and pain sucks, getting smashed by a heavy car, sucks too, and it is healthy fear you have, because that crash hurt like hell. fear is healthy, if keeps up alive, so talk to other family and friends about how they handle fears, you may be surprised at how many people have fears, its normal, we all go through them, at some point in the future, when you are ready, and if the opportunity presents itself, take a ride on a scooter in an empty parking lot somewhere on a early sunday morning, for a few minutes, just to prove you can do it, and to put some new memories on top of the traumatic ones, it takes time to heal, emotionally and physically, give yourself the gift of time, god bless good luck
